Welcome to The Foster Brothers Diesel Repair (“Foster Brothers,” “we,” “us,” or “our”). These Terms and Conditions govern your use of our website located at dieselrepair.org (the “Site”), including any purchases made through our online store. By accessing the Site or placing an order, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

1. About Us

Foster Brothers Diesel Repair is located at 330 Hwy 78 W, Jasper, AL 35501. We provide automotive and diesel repair services and sell automotive parts and accessories through our online store.

2. Use of the Site

You agree to use the Site only for lawful purposes. You may not use the Site in any way that could damage, disable, or impair the Site, or interfere with any other party’s use of the Site. We reserve the right to restrict or terminate your access to the Site at our discretion, without notice, for conduct that violates these Terms.

3. Products and Pricing

We make every effort to display accurate product information, pricing, and availability. However, errors may occur. We reserve the right to correct any errors, inaccuracies, or omissions, and to change or update information at any time without prior notice, including after an order has been submitted.

Prices are subject to change without notice. In the event a product is listed at an incorrect price due to an error, we reserve the right to cancel any orders placed for that product, whether or not the order has been confirmed.

Some products sold through the Site are supplied through third-party distributors, including Turn 14 Distribution, and are shipped directly to you from the distributor’s warehouse. Product images, descriptions, and specifications for these items are provided by the manufacturer or distributor and may vary slightly from the actual product.

4. Orders and Payment

By placing an order, you represent that you are authorized to use the payment method provided and that the information you supply is accurate and complete. We reserve the right to refuse or cancel any order for any reason, including suspected fraud, pricing errors, or product unavailability.

Payment is due in full at the time of purchase unless you elect to use financing through Synchrony Bank, subject to the separate terms and credit approval provided by Synchrony. [Financing disclosure language to be added once provided by Synchrony.]

5. Shipping

Shipping costs are calculated at checkout based on the items in your order, your delivery address, and the shipping method selected. Orders fulfilled through our distribution partners may ship directly from a third-party warehouse and may arrive separately from other items in your order.

Estimated delivery times are provided for convenience only and are not guaranteed. We are not responsible for delays caused by the carrier, the distributor, weather, or other circumstances outside of our control.

6. Returns and Refunds

Our return and refund process varies depending on whether an item was purchased in-store or shipped through one of our distribution partners. Please review our Return and Refund Policy for full details, including applicable timeframes, restocking fees, and items that are not eligible for return.

7. Warranties

Products sold through the Site may be covered by a manufacturer’s warranty. Except where required by law, Foster Brothers does not provide an independent warranty on parts sold through the Site beyond what is offered by the manufacturer or distributor.

Repair services performed by Foster Brothers, including installations using Jasper remanufactured products, may be covered under a separate warranty. Please see our Services page or ask a team member for current warranty details.

8. Intellectual Property

All content on the Site, including text, graphics, logos, images, and software, is the property of Foster Brothers or its licensors and is protected by applicable copyright and trademark laws. You may not copy, reproduce, distribute, or create derivative works from any content on the Site without our prior written permission.

9. Limitation of Liability

To the fullest extent permitted by law, Foster Brothers shall not be liable for any indirect, incidental, special, or consequential damages arising out of or related to your use of the Site or any products purchased through it. Our total liability for any claim arising from your use of the Site or a purchase made through it shall not exceed the amount you paid for the product or service giving rise to the claim.
